1. Acceptance

By accessing or using Adaptiv (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. What Adaptiv is

Adaptiv is a discovery and curation app for adaptive fashion, operated by Adaptiv Discovery™. We surface products from third-party brands and link out to those brands' websites. Adaptiv does not sell, ship, or fulfill any products directly.

3. Eligibility

You must be at least 13 years old to use Adaptiv. If you are under 18, you should review these terms with a parent or guardian.

4. Your account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us immediately of any unauthorized use.

5. Third-party products and links

Adaptiv links to products sold by independent brands. We are not responsible for the availability, quality, pricing, shipping, returns, or accuracy of any third-party product or website. Any purchase you make is a transaction between you and that brand.

6. Intellectual property

The Adaptiv name, logo, and all original content on the Service are owned by Adaptiv Discovery™ (the company behind Adaptiv). See our Intellectual Property page for details. You may not copy, reproduce, or create derivative works without written permission.

7. Acceptable use

You agree not to misuse the Service, including scraping, reverse-engineering, attempting to disrupt the Service, or using it for any unlawful purpose.

8. Product Information, Images, and Third-Party Content

Adaptiv helps users discover, explore, and compare products by organizing publicly available product information from brands, retailers, marketplaces, and other third-party sources (collectively, "Third-Party Content"). Product information displayed through Adaptiv may include product names, descriptions, specifications, attributes, availability information, pricing references, links, and image references associated with third-party product pages.

Adaptiv may use automated technologies to identify, organize, and display product information from publicly accessible webpages and third-party sources. Product images displayed through Adaptiv may be provided through third-party image URLs, source references, or publicly available webpage metadata. Where applicable, product images are displayed from their original third-party hosting locations rather than stored or hosted by Adaptiv.

Adaptiv provides product discovery and referral functionality and does not represent itself as the manufacturer, seller, owner, or authorized distributor of third-party products unless explicitly stated. Third-Party Content remains associated with its respective owners and providers, and Adaptiv does not alter ownership rights in Third-Party Content.

Intellectual property in Third-Party Content. Third-party trademarks, copyrights, product images, descriptions, and other intellectual property remain the property of their respective owners. Adaptiv does not claim ownership of third-party product content. Product references are provided for identification, discovery, comparison, and informational purposes. Displaying product information does not imply sponsorship, endorsement, partnership, or affiliation unless explicitly stated.

Accuracy and availability. Adaptiv makes reasonable efforts to provide useful and accurate information but does not guarantee that Third-Party Content is complete, current, accurate, or error-free. Product availability, pricing, specifications, and imagery may change or become unavailable. Users should verify final product details with the applicable brand, retailer, or seller before making purchasing decisions. Adaptiv may update, modify, replace, or remove product references as part of maintaining the platform.

AI-assisted content. Portions of the Service may use automated systems, machine learning, and generative AI to produce summaries, classifications, tags, attribute extraction, translations, descriptions, and recommendations. This content is informational and should be independently verified before being relied upon.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. Adaptiv does not guarantee that product listings, images, descriptions, prices, or availability are accurate, current, complete, or uninterrupted.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Adaptiv, Adaptiv Discovery™, or their respective affiliates, officers, directors, employees, contractors, agents, licensors, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to (a) your access to or use of, or inability to access or use, the Service; (b) any Third-Party Content or AI Content, including any inaccuracies, outdated information, errors, or omissions therein; (c) any conduct or content of any third party on or linked from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content. Your sole and exclusive remedy for dissatisfaction with the Service is to stop using it.

11. Indemnification

You agree to defend, indemnify, and hold harmless Adaptiv, Adaptiv Discovery™, and their respective affiliates, officers, directors, employees, contractors, agents, licensors, and partners from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or reliance on the Service or any Third-Party Content or AI Content; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit, post, or transmit through the Service.

12. Preservation of non-excludable rights

Nothing in these Terms is intended to exclude, restrict, or modify any right, remedy, warranty, guarantee, or liability that cannot legally be excluded, restricted, or modified under applicable law. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

13. Changes

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
